Statement Regarding Court's Decision to Keep Diamond Centre Road Open
On April 8, Lake County Common Pleas Judge John O’Donnell posted his judgment entry on the City of Painesville’s motion against the City of Mentor over the closure of Diamond Centre Drive at the Mentor/Painesville border.
To be awarded this preliminary injunction, Painesville had to prove (1) there is a likelihood of success on the merits (from the original 2003 agreement and amendments), (2) irreparable injury will occur if the injunction is not granted, (3) the rights of third parties will not be harmed and (4) the injunction will serve public interest. The court agreed with Painesville City’s stance, resulting in Diamond Centre Drive remaining open between Painesville and Mentor.
“I will let the court’s decision speak for itself,” said Monica Irelan Dupee, Painesville City Manager. “The safety and way of life of our residents and businesses has always been our first concern and we are glad the court agrees.”
“However, the issue of traffic flow in the Diamond Center area remains. We are still willing to work with Mentor to find a long-term, sustainable solution that works for both communities,” said Dupee.
