STATEMENT REGARDING REPUBLIC LITIGATION

The City of Painesville is aware Republic Services is currently threatening residents with collection action for a disputed $50.00 per can collection fee. The City is involved in on-going litigation with Republic regarding this fee and it may be some time before it is resolved.

In an earlier hearing, the Federal Court did observe that, “[b]ased on the exhibits and record before it, the Court would find that it is likely the City would succeed on its breach of contract claim against Republic, to the extent that Republic breached the Contract by charging residents a collection fee for any pre-Addendum carts.”

The City of Painesville did request Republic suspend their collection efforts pending final resolution of the court case, but so far, they have refused.

Since this matter is still currently before the Court, at this time, the City is unable to advise you whether or not to pay this fee. However, we are vigorously working to right this wrong on the behalf of Painesville residents.
