Position Objectives:
This is responsible work in the operation of the Civil Division of the Painesville Municipal Court.
Work involves responsibility for accurately performing clerical tasks related to the operations of the Civil Division, including preparation of court docket and maintenance of the records of civil cases. Detailed instructions and relatively close supervision are received at the beginning of work and on new assignments, although regular assignments once learned are usually performed independently, with advice and assistance available when unusual or difficult matters arise. Work is performed under the supervision of the Civil Supervisor and is reviewed through observation of operations and examination of official records for accuracy.
Duties and Responsibilities:
- Receipts, prepares, and maintains official civil records and documents. See attached example of duties.
- Assists plaintiffs in the filing of civil actions; determines whether citizen's complaint meets venue and jurisdiction requirements; reduces complaint to writing.
- Performs initial processing of civil actions; assigns case number and collects filing fees; issues summonses to appear in court; prepares case jackets and docket sheets; indexes case.
- Schedules court dates, based on legal time limits for processing civil cases, availability of court time, and schedules of court officials involved; prepares hearing notices for all involved parties.
- Processes documents utilized for the enforcement of civil judgments, including garnishments of personal earnings or bank accounts, liens upon property, execution upon personal property, examination before Judge, and evictions.
- Prepares journal entries for Judge's journal.
- Explains court procedures to citizens, attorneys, and legal secretaries.
- Performs related work as required.
Minimum Requirements:
Education: High school diploma
Experience: Court related or legal work preferred.
A different combination of education and experience may be acceptable if deemed equivalent.
License or Certification Required: Valid Ohio Driver’s License or ID
Desirable Training and Experience:
Knowledge of:
- Considerable knowledge of the Civil Rules of Procedure and of legal documents, laws, and legal factors pertaining to civil actions.
- Knowledge of the organization, functions, responsibilities, and procedures of municipal courts.
- Modern office procedures and practices.
Skill and Ability to:
- Train and apply procedures.
- Communicate clearly and concisely, orally and in writing.
- Take dictation.
- Establish and maintain effective working relationships with court officials, employees, and the public.
- Maintain a variety of complex records and prepare reports from such records.
- Skill in typing accurately from legal documents and rough drafts at a reasonable working rate of speed.
